Subject-To transaction coordinator

Subject-to transaction coordinator, one file at a time.

In a subject-to purchase the buyer takes title to the property and the seller’s existing loan stays in place, still being paid. Standard deeds of trust give the lender the option to call the loan when the property transfers, so the recorded deed of trust gets read before anything else. Kristen keeps that file moving between your attorney, your title company and your servicer.

What Kristen coordinates

The subject-to checklist. Tap each item as you read it.

Every subject-to file gets this list, in this order. When the bar is full, you have seen everything Kristen tracks from contract to first payment.

What she does not do

Kristen coordinates. The licensed people do the licensed work.

On a subject-to file the lines are the same as on every file. Clear roles are what keep a creative deal clean.

  1. 01

    Your attorney drafts

The note, deed of trust, addenda and any state-required notices come from your attorney. Kristen never drafts a legal document and never gives legal or tax advice.

  2. 02

    Your title company closes

Title search, commitment, closing, funding and recording happen at your title company or closing attorney. Kristen keeps them supplied and on schedule.

  3. 03

    Your servicer collects

Payments after closing run through a loan servicer. Kristen sends the setup packet and confirms the account is live. The servicer collects.

  4. 04

    A lender lends

Dean Creative Closings is not a lender or mortgage loan originator. Who may originate a seller-carried note is a question for your attorney or RMLO.

Dean Creative Closings is not a law firm, lender, mortgage loan originator or title company and does not give legal or tax advice.

Questions

The ones subject-to clients ask first.

Plain answers. The full list is on the FAQ page.

What about the due-on-sale clause?

Standard deeds of trust let the lender accelerate the loan when the property is transferred. Kristen does not advise on that risk. She pulls the recorded deed of trust so your attorney can read it, and she tracks whatever your attorney decides the file needs.

Who talks to the existing lender?

Once the seller signs an authorization, Kristen requests the mortgage statement and confirms the loan details for the file. The authorization form is one of the first items on the checklist.

Does the seller’s insurance just carry over?

No. A new policy is placed with the right parties named and the old policy is handled. Kristen works with your insurance agent and confirms the binder before closing.

Do you give legal or tax advice?

No. Dean Creative Closings is not a law firm, lender, mortgage loan originator or title company. Kristen keeps the file organized and moving between the people who do those jobs.
